Report listing violations or problems with another LoopCity.com member.
Violations of this policy may result in a range of actions, including
• Listing cancellation
• Limits on account privileges
• Account suspension
• Forfeit of LoopCity.com fees on cancelled listings
• Loss of PowerSeller status
• We encouraged everybody to follow this rule as we are required by our Government Agencies and Homeland Security Agencies to follow this Laws.
Academic Software
• Academic software is software sold at significantly discounted prices to students, faculty members and educational institutions. Do not list academic copies of software on LoopCity.com unless you are authorized to do so as an educational reseller, an educational institution a student or a faculty member.
Alcohol (also see Wine)
• LoopCity.com does not permit the sale of alcoholic beverages on its U. S. website, except for certain pre-approved sales of wine (see Additional Information) and certain sales of collectible containers. Further, non-U.S. members may not conduct alcohol sales with any LoopCity.com member residing in the United States.
Animals and Wildlife Products
• LoopCity.com generally does not allow the listing of live animals or pets on LoopCity.com. In restricted cases, some stuffed birds and the pelts and skins of some animals are permitted. Sellers who wish to list these items should review the specific rules in the “Some Examples” section below to ensure their listings comply with LoopCity.com policy. We also encourage members to educate themselves on the laws governing the regulation of the sale of animals found in the additional information section.
• Live Animals: Other than the exceptions noted here, LoopCity.com does not allow sales of live animals or pets on LoopCity.com. LoopCity.com allows sales of tropical fish and domestic (i.e. not exotic) aquatic snails, provided the seller has the proper Federal (APHIS PPQ) - see Form 526 info below) and/or State permit(s) that allows for movement across State lines (and/or for importation into the U. S.), and provided that the seller guarantees in the listing that the animals will be packaged safely, and shipped via next day delivery.
Animal and Plant Health Inspection Service allows five species of snails to be imported and sold as escargot: Cantareus apertus (Helix aperta), Cryptomphalus aspersus (Helix aspersa), Eobania vermiculata (Otala vermiculata), Helix pomatia, and Otala lactea; and requires their importation to take place through John F. Kennedy International Airport in New York where identifiers will confirm the identity of live snails. Stuffed Birds: With a few specific exceptions (see below), mounted ("stuffed") specimens of any wild birds, parts of any wild bird, or the nests or eggs of any wild bird are not permitted on LoopCity.com. Exceptions:
o Mounted specimens of captive-bred, properly marked Mallard ducks may be sold if the seller clearly states in the item description that the specimen was captive bred. No other captive-bred native waterfowl species may be sold without permits obtained from the U.S. Fish & Wildlife Service. Sale or barter of legally hunted wild waterfowl and migratory game birds, including (but not limited to) ducks, geese, snipe, woodcock, cranes, and doves, is prohibited by federal law.
o Mounted specimens or parts of legally hunted upland game birds, which include quail, turkey, pheasant, and grouse, may generally be listed on LoopCity.com if not listed or sold in violation of the state wildlife laws of the states of the buyer or seller.
o Mounted specimens, feathers, and eggs of captive-bred, non-endangered non-native birds such as ostriches, emus, exotic pheasants, Mandarin ducks, guinea fowl, peafowl, and most parrots may be listed on LoopCity.com if not listed or sold in violation of state or local laws applicable to the buyer or seller.
• Animal pelts and skins: Animal parts, including pelts and skins from endangered species (such as leopards, tigers, cheetahs, jaguars, sable antelopes, mountain zebras, and Hartmann mountain zebras) may not be sold in interstate commerce and therefore are not permitted on LoopCity.com. Animal pelts and skins from non-endangered species (for example, non-protected species of zebras, coyotes) may generally be listed on LoopC ity.com, if not in violation of the seller's specific state laws. However, because prohibited by federal law, no sales of any item that contains cat or dog fur will be allowed. Please contact USFWS to file declarations on all non-domesticated animal products. Please note that if the species is not stated in the listing, LoopCity.com will use its discretion when determining if the item is from an endangered species.
• Other Animal Parts: Endangered or protected species, or any part of any endangered or protected species may not be listed on LoopCity.com.
• Bear Products: Bears and bear products (for example, bear teeth, claws, and rugs) are not permitted on LoopCity.com. For more information on Polar Bears, please see LoopCity.com’s Marine Mammal guidelines below.
• Mountain Lions: Products that contain any part from a mountain lion may not be listed on LoopCity.com.
• Marine Mammal Products: Marine mammal products, including but not limited to polar bear, sea otter, whales (baleen and ivory), porpoise, dolphins, and seals, generally may not be listed for sale unless the animal part has been first transformed into an authentic Alaskan Native article of handicraft or clothing. The export/import of marine mammals typically requires CITES as well as other state and/or federal permits. Users should contact the U.S. Fish and Wildlife Service and/or National Marine Fisheries Service before importing or exporting marine mammal products
• Ivory: This area is complex, and sellers should consult with the U.S. Fish and Wildlife Serviceand their state wildlife regulatory agency to ensure that the particular item involved may lawfully be sold. Generally, ivory from African elephants may be sold within the United States as long as it was lawfully imported into the United States. Wooly mammoth ivory may be sold inside or outside the United States. Hippo ivory may be sold within the United States, but may not lawfully be imported into the United States, but may only be imported/exported in compliance with CITES.
• Internal Organs of Animals: Internal organs of animals (for example, bear gall bladders) may not be listed on LoopCity.com.
• Products made from "tortoise shell" or other turtle products: There are a number of items that have been made, both lawfully and unlawfully, from the shell of the hawksbill turtle, a sea turtle that is now an endangered species protected by federal and international law. At one time, it was lawful to make jewelry, glasses, boxes, and other items using the shell of the hawksbill turtle. However, the 1973 Endangered Species Act made it unlawful to sell items made in whole or part out of genuine hawksbill tortoise shells. LoopCity.com will not permit the sale of any item made, in whole or part, from any part of a sea turtle. This includes items such as guitar picks, jewelry, jewelry boxes, hair combs, and other products made from the shell of the hawksbill turtle. Items that appear from the listing to be made from genuine tortoise shell are not permitted. LoopCity.com realizes that users commonly use the phrase "tortoise shell" to describe items that have a particular design resembling a tortoise shell, and that many "tortoise shell" products are actually made out of plastic, glass, or a composite material. These items are permitted on LoopCity.com. However, to avoid confusion, listings of such "faux" tortoise shell items should clearly state that the item is not made of "genuine" tortoise shell.
Anti-circumvention Policy
• Do not list any hardware or software that would enable users to "rip" or otherwise make unauthorized copies of copy-protected video games, software programs, CD-ROMs, DVDs, or CDs. Encouraging the use of devices or software designed to defeat copy-protection measures is also not allowed on LoopCity.com.
• Listings violating LoopCity.com's anti-circumvention policy may be ended early by LoopCity.com. Multiple violations of LoopCity.com's anti-circumvention policy could result in the suspension of your account.
Artifacts
• Artifacts, cave formations (speleothems, stalactites, and stalagmites) and grave-related items that are protected under federal laws, such as The Federal Cave Resources Protection Act of 1988, and the Native American Grave Protection and Repatriation Act are not permitted on LoopCity.com.
Authenticity Disclaimers
• Sellers may not disclaim knowledge of, or responsibility for, the authenticity or legality of the items offered in their listings.Sellers should take steps to ensure that their items are authentic before listing them on LoopCity.com. If a seller cannot verify the authenticity of an item, the seller is not permitted to list it.
Autographed Items
• Autographed items are unique in that they can be highly valuable, but easily forged. LoopCity.com tries to keep its marketplace safe for both buyers and sellers of autographs, and has developed the following policies to protect our community members:
• Sellers may not list blank Certificates of Authenticity (COAs) or sell COAs as stand-alone items.
• Sellers may not refer in their listings to examinations or certificates of authenticity issued by the parties mentioned in the “Unacceptable Authenticators” section under “Additional Information” below.
• Sellers are strongly urged to follow the listing guidelines described in the “Additional Information” section below.
Beta Software:
• Beta software, test software and evaluation software are not permitted on the LoopCity.com site. These are early copies of software distributed by software developers strictly for the purpose of evaluation and troubleshooting. Violations of this policy may result in a range of actions, including:
Bonus, Prize, Giveaway and Raffle
• LoopCity.com does not permit listings that promote giveaways, random drawings, raffles, or prizes, because these promotions are highly regulated and may be unlawful in many states. LoopCity.com itself may run such promotions on the site, and may grant authorization to its partners or third party companies to run promotions that comply with applicable laws.
• LoopCity.com does not permit bonus listings in which the seller does not state the exact amount at which the bonus will apply, or Multiple Item Listings in which the exact same bonus is not offered to all buyers.
Bootleg Recordings
• Bootleg recordings are unauthorized recordings of concerts or live performances. Sellers are not permitted to list bootleg recordings on LoopCity.com.
Brand Name Misuse
• Keyword spamming occurs when members place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting members to a listing. Keyword spamming in listings is not permitted on LoopCity.com. The searchable text sellers place in listings must be directly relevant to the item being sold
Catalog Sales
• Listings of catalogs from which buyers may directly order are not permitted.
• Old and collectible catalogs (from which you can no longer place an order) are permissible. However, the title or description may not contain extensive lists of specific items included in the catalog. Sellers wishing to list these catalogs should review the ‘Additional Information’ section below and adhere to its policies.
Catalytic Converters and Test Pipes
• The sale of catalytic converters on LoopCity.com is permitted with the exception of those prohibited by the US Government. See “Additional Information” below for a link to a list of banned catalytic converters.
Celebrity Material
• The sale of catalytic converters on LoopCity.com is permitted with the exception of those prohibited by the US Government. See “Additional Information” below for a link to a list of banned catalytic converters.
