Academic
Software
·
Academic software is software sold at significantly
discounted prices to students, faculty members and educational
institutions. Do not list academic copies of software on
LoopCity.com unless you are authorized to do so as an educational
reseller, an educational institution a student or a faculty
member.
Alcohol
(also see Wine)
·
LoopCity.com does not permit the sale of alcoholic
beverages on its U. S. website, except for
certain pre-approved sales of wine (see Additional Information) and
certain sales of collectible containers. Further, non-U.S. members
may not conduct alcohol sales with any LoopCity.com member residing
in the United
States .
Animals and
Wildlife Products
·
LoopCity.com generally does not allow the listing of
live animals or pets on LoopCity.com. In restricted cases, some
stuffed birds and the pelts and skins of some animals are permitted.
Sellers who wish to list these items should review the specific
rules in the “Some Examples” section below to ensure their listings
comply with LoopCity.com policy. We also encourage members to
educate themselves on the laws governing the regulation of the sale
of animals found in the additional information section.

Live Animals: Other than the exceptions
noted here, LoopCity.com does not allow sales of live animals or
pets on LoopCity.com. LoopCity.com allows sales of tropical fish and
domestic (i.e. not exotic) aquatic snails, provided the seller has
the proper Federal (APHIS PPQ) - see Form 526 info below) and/or
State permit(s) that allows for movement across State lines (and/or
for importation into the U. S.), and provided that the seller
guarantees in the listing that the animals will be packaged safely,
and shipped via next day delivery.
Animal and Plant Health
Inspection Service allows five species of snails to be imported and
sold as escargot: Cantareus apertus (Helix aperta), Cryptomphalus
aspersus (Helix aspersa), Eobania vermiculata (Otala vermiculata),
Helix pomatia, and Otala lactea; and requires their importation to
take place through John
F. Kennedy International Airport in New York where identifiers will
confirm the identity of live snails. Stuffed Birds:
With a few specific exceptions (see below), mounted ("stuffed")
specimens of any wild birds, parts of any wild bird, or the nests or
eggs of any wild bird are not permitted on LoopCity.com.
Exceptions:
o
Mounted specimens of captive-bred, properly marked
Mallard ducks may be sold if the seller clearly states in the item
description that the specimen was captive bred. No other
captive-bred native waterfowl species may be sold without permits
obtained from the U.S. Fish & Wildlife Service. Sale or barter
of legally hunted wild waterfowl and migratory game birds, including
(but not limited to) ducks, geese, snipe, woodcock, cranes, and
doves, is prohibited by federal law.
o
Mounted specimens or parts of legally hunted upland
game birds, which include quail, turkey, pheasant, and grouse, may
generally be listed on LoopCity.com if not listed or sold in
violation of the state wildlife laws of the states of the buyer or
seller.
o
Mounted specimens, feathers, and eggs of captive-bred,
non-endangered non-native birds such as ostriches, emus, exotic
pheasants, Mandarin ducks, guinea fowl, peafowl, and most parrots
may be listed on LoopCity.com if not listed or sold in violation of
state or local laws applicable to the buyer or seller.
·
Animal pelts and skins: Animal parts,
including pelts and skins from endangered species (such as leopards, tigers,
cheetahs, jaguars, sable antelopes, mountain zebras, and Hartmann
mountain zebras) may not be sold in interstate commerce and
therefore are not permitted on LoopCity.com. Animal pelts and skins
from non-endangered species (for example, non-protected species of
zebras, coyotes) may generally be listed on LoopCity.com, if not in
violation of the seller's specific state laws. However, because
prohibited by federal law, no sales of any item that contains cat or
dog fur will be allowed. Please contact USFWS to file declarations
on all non-domesticated animal products. Please note that if the
species is not stated in the listing, LoopCity.com will use its
discretion when determining if the item is from an endangered
species.

Other Animal Parts: Endangered or
protected species, or any part of any endangered or protected
species may not be listed on LoopCity.com.
·
Bear Products: Bears and bear products
(for example, bear teeth, claws, and rugs) are not permitted on
LoopCity.com. For more information on Polar Bears, please see
LoopCity.com’s Marine Mammal guidelines below.
·
Mountain Lions: Products that contain any part
from a mountain lion may not be listed on LoopCity.com.
·
Marine Mammal Products: Marine mammal
products, including but not limited to polar bear, sea otter, whales
(baleen and ivory), porpoise, dolphins, and seals, generally may not
be listed for sale unless the animal part has been first transformed
into an authentic Alaskan Native article of handicraft or clothing.
The export/import of marine mammals typically requires CITES as well
as other state and/or federal permits. Users should contact the U.S. Fish and Wildlife
Service and/or National Marine Fisheries Service before importing
or exporting marine mammal products.

Ivory: This area is complex, and sellers should
consult with the U.S.
Fish and Wildlife Serviceand their state wildlife regulatory
agency to ensure that the particular item involved may lawfully be
sold. Generally, ivory from African elephants may be sold within the
United States as
long as it was lawfully imported into the United
States . Wooly mammoth ivory may be
sold inside or outside the United States . Hippo
ivory may be sold within the United States, but may not lawfully be
imported into the United States, but may only be imported/exported
in compliance with CITES.
·
Internal Organs of Animals: Internal organs of
animals (for example, bear gall bladders) may not be listed on
LoopCity.com.
·
Products made from "tortoise shell" or other turtle
products: There are a number of items that have been made,
both lawfully and unlawfully, from the shell of the hawksbill
turtle, a sea turtle that is now an endangered species protected by
federal and international law. At one time, it was lawful to make
jewelry, glasses, boxes, and other items using the shell of the
hawksbill turtle. However, the 1973 Endangered Species Act made it
unlawful to sell items made in whole or part out of genuine
hawksbill tortoise shells. LoopCity.com will not permit the sale of
any item made, in whole or part, from any part of a sea turtle. This
includes items such as guitar picks, jewelry, jewelry boxes, hair
combs, and other products made from the shell of the hawksbill
turtle. Items that appear from the listing to be made from genuine
tortoise shell are not permitted. LoopCity.com realizes that users
commonly use the phrase "tortoise shell" to describe items that have
a particular design resembling a tortoise shell, and that many
"tortoise shell" products are actually made out of plastic, glass,
or a composite material. These items are permitted on LoopCity.com.
However, to avoid confusion, listings of such "faux" tortoise shell
items should clearly state that the item is not made of "genuine"
tortoise shell.
Anti-circumvention
Policy
·
Do not list any hardware or software that would enable
users to "rip" or otherwise make unauthorized copies of
copy-protected video games, software programs, CD-ROMs, DVDs, or
CDs. Encouraging the use of devices or software designed to defeat
copy-protection measures is also not allowed on LoopCity.com.
·
Listings violating LoopCity.com's anti-circumvention
policy may be ended early by LoopCity.com. Multiple violations of
LoopCity.com's anti-circumvention policy could result in the
suspension of your account.
Artifacts
·
Artifacts, cave formations (speleothems, stalactites,
and stalagmites) and grave-related items that are protected under
federal laws, such as The Federal Cave Resources Protection Act of
1988, and the Native American Grave Protection and Repatriation Act
are not permitted on LoopCity.com.
Authenticity
Disclaimers
·
Sellers may not disclaim knowledge of, or
responsibility for, the authenticity or legality of the items
offered in their listings.Sellers should take steps to ensure that
their items are authentic before listing them on LoopCity.com. If a
seller cannot verify the authenticity of an item, the seller is not
permitted to list it.
Autographed
Items
·
Autographed items are unique in that they can be
highly valuable, but easily forged. LoopCity.com tries to keep its
marketplace safe for both buyers and sellers of autographs, and has
developed the following policies to protect our community
members:

Sellers may not list blank Certificates of
Authenticity (COAs) or sell COAs as stand-alone items.
·
Sellers may not refer in their listings to
examinations or certificates of authenticity issued by the parties
mentioned in the “Unacceptable Authenticators” section under
“Additional Information” below.
·
Sellers are strongly urged to follow the listing
guidelines described in the “Additional Information” section
below.
Beta
Software:
·
Beta software, test software and evaluation software
are not permitted on the LoopCity.com site. These are early copies
of software distributed by software developers strictly for the
purpose of evaluation and troubleshooting. Violations of this policy
may result in a range of actions, including:
Bonus,
Prize, Giveaway and Raffle
·
LoopCity.com does not permit listings that promote
giveaways, random drawings, raffles, or prizes, because these
promotions are highly regulated and may be unlawful in many states.
LoopCity.com itself may run such promotions on the site, and may
grant authorization to its partners or third party companies to run
promotions that comply with applicable laws.
·
LoopCity.com does not permit bonus listings in which
the seller does not state the exact amount at which the bonus will
apply, or Multiple Item Listings in which the exact same bonus is
not offered to all buyers.
Bootleg
Recordings
·
Bootleg recordings are unauthorized recordings of
concerts or live performances. Sellers are not permitted to list
bootleg recordings on LoopCity.com.
Brand
Name Misuse
·
Keyword spamming occurs when members place brand names
or other inappropriate keywords in a title or description for the
purpose of gaining attention or diverting members to a listing.
Keyword spamming in listings is not permitted on LoopCity.com. The
searchable text sellers place in listings must be directly relevant
to the item being sold
Catalog
Sales
·
Listings of catalogs from which buyers may directly
order are not permitted.
·
Old and collectible catalogs (from which you can no
longer place an order) are permissible. However, the title or
description may not contain extensive lists of specific items
included in the catalog. Sellers wishing to list these catalogs
should review the ‘Additional Information’ section below and adhere
to its policies.
Catalytic
Converters and Test Pipes
·
The sale of catalytic converters on LoopCity.com is
permitted with the exception of those prohibited by the US
Government. See “Additional Information” below for a link to a list
of banned catalytic converters.
Celebrity
Material
·
LoopCity.com prohibits sellers from listing CDs, DVDs,
VCDs and screen saver programs that contain multiple images, still
photographs, or videos of multiple celebrities and models.
·
Selling photography and images of celebrities
("Celebrity Material") often involves both intellectual property
rights (like copyrights) and rights of publicity (a person’s right
to control commercial exploitation of his or her image, likeness
etc.) which may be owned by people other than the person listing the
item for sale. Sellers need to be certain that their listings comply
with third party copyrights and/or rights of publicity.

Cell
Phone (Wireless) Service Contracts
·
Cell phone service contracts may be sold on
LoopCity.com alone or bundled with a phone.
·
Sellers listing a phone bundled with a required
service contract must
·
List only in the Phones with New Plan Purchase section
of the Cell Phones category.
·
Be an authorized reseller of cell phone services.
·
Offer a full refund within 10 days of payment to any
buyer who is rejected for a service contract.
·
Clearly state in listings what regions, states or zip
codes of the country are serviced and any restrictions buyers may
encounter.
·
Offer and include the following text in all bundled
listings:
"As an authorized reseller of cell phone services,
I will provide a full refund within 10 days to any buyer that does
not qualify for our service. This may occur if the buyer is located
outside the area that I am authorized to resell or if the buyer is
rejected for other reasons such as not passing our credit
requirements.
Charity
or Fundraising Listings
·
Charitable fundraising is a highly regulated area
subject to numerous state and federal laws. LoopCity.com allows
sellers to list items and collect proceeds (in whole or in part) on
behalf of charity either with LoopCity.com Giving Works (the
dedicated program for charity listings on LoopCity.com) or without
LoopCity.com Giving Works (as long as the listings meet our specific
guidelines for charitable solicitations).
Comparison
Policy

Listings that include
compilations or informational content on any media must:

Not be combined as a bonus item with any other
listing.

Not contain any specific brand names or keywords
unless the listing is offering the item in question.
·
Not contain excessive use of keywords to describe the
contents of the compilation or informational media.

Not offer information on how to either purchase
specific items or receive them for free, outside of
LoopCity.com.
·
Not provide listings of URLs that offer buyers the
opportunity to purchase items outside of LoopCity.com.
Contracts
and Tickets
·
Sellers
should avoid listing an item which the seller is not permitted to
sell due to contractual obligations entered into with a third party.
Prior to listing items on LoopCity.com, sellers should carefully
read any contract they have entered into that might prohibit or
limit their rights to sell items on LoopCity.com.
Counterfeit
Currency and Stamps
Most countries strictly prohibit the
sale of counterfeit currency and stamps as well as equipment
designed to make these illegal products. Therefore, these types of
items may not be listed on LoopCity.com.
Replica coins may be listed as long
as they are clearly marked "reproduction," "replica," or "copy". See
Additional Information
All forged stamps, facsimiles, and
reproductions may be listed but need to be clearly and indelibly
marked as such on either the front or back of the stamp. See
“Additional Information” for more details.
Counterfeit
Items
·
Counterfeits, unauthorized replicas, unauthorized
items (such as counterfeit watches, handbags, or other accessories)
or unauthorized copies (such as copies of software programs, video
games, music albums, movies, television programs, or photographs)
are not permitted on LoopCity.com. Unauthorized copies include (but
are not limited to) copies that are pirated, duplicated, backed-up
or bootlegged. It is illegal to sell unauthorized copies of
media.
Credit
Cards
LoopCity.com permits the listing of
inactive credit or debit cards, provided that the expiration date on
the face of the card is at least 10 years old. Such 10-year old,
expired debit/credit cards may be considered ’collectible’ and may
have some collectible value, Sellers should examine the terms and
conditions on the card to ensure that the sale of the expired card
is permitted.
If posting a picture of the card, the
seller should cover or block out at least part of the name and/or
credit card number.
Describing
Drugs or Drug-like Substances
LoopCity.com prohibits sellers from
describing legal substances, such as plants or herbs, in a manner
that suggests ingesting, inhaling, extracting or otherwise using any
substance or compound from the legal substance will provide the same
effect as an illegal drug, compound or substance or that will
provide unsubstantiated health benefits.
LoopCity.com looks to the Federal
Trade Commission, the Food and Drug Administration and other
regulatory agencies for guidance on items that violate their
policies on inappropriate marketing.
Downloadable
Media
Digitally
delivered items are restricted on LoopCity.com. In order to list
digitally delivered items, the seller must comply with the following
requirements:
- Any
digitally delivered item may not be pornographic in nature.
- The
seller must be the owner of the underlying intellectual
property, or authorized to distribute it by the intellectual
property owner.
- The
seller’s item may not include software that harms the buyer’s
machine (for example, a virus), uses it for malicious or
unauthorized purposes (for example, sending spam emails or
spreading a virus), or violates the buyer’s privacy (for example,
spyware or cookies per the HTML and JavaScript policy).
- To
help verify the identity of sellers listing digital downloadable
items, LoopCity.com requires that sellers are PayPal Verified.

Drugs &
Drug Paraphernalia
Narcotics, steroids or other
controlled substances may not be listed on LoopCity.com.
Drug paraphernalia may not be listed
on LoopCity.com. Such paraphernalia includes all items that are
primarily intended or designed for use in manufacturing, concealing
or using a controlled substance.
Electronics
Equipment
·
Certain
electronics equipment, including equipment deemed unlawful by the
Federal Communications Commission (FCC), is not permitted on
LoopCity.com.
Embargoed
Goods and Prohibited Countries
·
Various
U.S. agencies
have sanctions in place that substantially regulate or ban all trade
with particular countries (including Cuba , Iran , Iraq , Libya , North Korea
and other countries). Federal agencies have
also banned or regulated trade between U.S.
persons with certain organizations, businesses
and persons. As a result, LoopCity.com does not permit the sale of
embargoed items from, with or to those countries, organizations,
businesses or persons.

Under U.S. law, trade in items made in
Cuba may not be
lawful, depending on the nature of the item, when it was
manufactured, and when it left Cuba
, among other factors. Generally, items from Cuba
may be sold only if they are "informational,"
"pre-embargo," or "licensed."
·
Sellers willing to ship internationally, and sellers
of items made outside the United States , should
periodically review current information about which countries may be
affected by sanctions enforced by the Office of Foreign Assets
Control of the U.S. Department of the Treasury. See “Additional

Illegal Activity

LoopCity.com prohibits the sale of items or links to
items that encourage, promote, facilitate or instruct others to
engage in illegal activity.

Sellers may not use the LoopCity.com site to enable,
encourage or instruct others to infringe copyrights, trademarks or
other rights
·
Event
Tickets LoopCity.com permits resale of tickets to entertainment
events (including sporting events, concerts, and plays) to the
fullest extent permitted by law. Ticket sellers are responsible for
ensuring that transactions do not violate any applicable law. For
information on specific state guidelines, please see "Additional
Information" below.
International Seller
Policy
Sellers listing
event tickets for resale from an LoopCity.com site other than
www.LoopCity.com.com for one of the regulated locations listed
above, may not exceed the pricing limitations set forth above,
regardless of the location of the seller or the buyer. Sellers must
also clearly include the following in their listing:

The location where the event will occur,
and
·
If it is a Regulated Location, the face value of the
ticket, the number of tickets, and the following text: Due to
laws regulating ticket sales in this area, the seller in this
auction will not accept any bids or offers to buy above the total
face value $__ printed on the ticket(s), plus $ permitted in some
states. Do not bid more than this amount. Bids that exceed this
amount are void and will be cancelled by the seller. The seller will
end the listing if, and when, this price is met.
Faces,
Names and Signatures
·
Sellers
are not permitted to list an item containing the image, likeness,
name, or signature of another person unless the product was made or
authorized by that person
Firearms,
Weapons and Knives
·
Since many firearm-related items, gun parts, gun
accessories, paintball equipment and accessories, stun guns,
crossbows, airsoft equipment and accessories, hand weapons and
throwing knives are not
permitted on LoopCity.com, sellers must carefully review the
‘Some Examples’ section below before listing these items and adhere
to all the policies outlined
Food
·
The sale of food is regulated by the federal
government and most state governments. Sellers who list food and
food-related products should familiarize themselves with these laws
before listing such items on LoopCity.com. Prior to listing any food
on LoopCity.com, sellers should read the ‘Additional Information’
section to learn more about what food items are not permitted.
Gift
Cards
·
LoopCity.com permits the listing of gift cards, with
the following restrictions:
·
The value of the gift card may not exceed $500.
·
Gift cards may not be sold as pre-sale items and must
be in hand at the time of listing.
·
Only one gift card may be listed per week, per seller.
No exceptions will be made for sellers with multiple accounts. For
the purposes of this policy, LoopCity.com defines one week as seven
days from the end of the previous Gift Card listing close.
·
Multiple Gift Cards cannot be combined under a single
listing
·
LoopCity.com, at its discretion, may approve 1st party
suppliers, or authorized 3rd party contractors, to sell gift cards
in excess of these restrictions.
Government
and Transit Documents
·
Any official internal, non-public documents, manuals,
or other materials related to mass commercial public transportation,
including internal manuals put out by commercial airlines, or
entities operating subways, trains, or buses are not permitted on
LoopCity.com.
Government
and Transit Uniforms
Any article of clothing or
identification relating to transportation security or employment
with any transportation related industry is not permitted on
LoopCity.com.

Vintage commercial airline, train, or subway clothing
such as ties, scarves, jackets, and similar items, may be sold so
long as the item description clearly states that the item is at
least 10 years old, is no longer in use by the airline, and does not
resemble any piece of the airline's current uniform
Government
IDs and Licenses
·
Government IDs and licenses, or items that claim to
be, or that look similar to, government identification documents are
not permitted on LoopCity.com, we don’t tolerate and report this to
Homeland Security Agency
Hazardous,
Restricted, and Perishable Items
·
Hazardous or dangerous goods (such as explosives,
radioactive materials, flammable gases, liquids and solids, and
toxic substances) may pose a danger to health, safety or property
while being transported, Many hazardous goods cannot be shipped
through the mail or commercial carrier at all. Such items are not
permitted on LoopCity.com. Please review the examples and additional
information sections below for more information on specific limits
and exceptions to this policy.

A few hazardous materials may legally be transported
under certain conditions if they are properly packaged and labeled.
Such items are permitted on LoopCity.com, provided that the listing
contains a clear notice of the hazardous nature of the material, and
a description of the planned method of shipping that complies with
the law. For details on particular hazardous substances and
transportation requirements in the US and internationally, look at the
U.S. Postal Service Publication 52
Human Parts
and Remains
·
Humans,
the human body, or any human body parts are not permitted on
LoopCity.com. Items that contain human hair (such as lockets) as
well as skulls and skeletons that are used for medical purposes may
be listed on LoopCity.com. LoopCity.com does not permit the sale of
Native American skulls, bones or other Native American grave-related
items, as the sale of such items may violate federal law.
Importation
of Goods into the United States
·
Members
importing goods into the United
States from another country, either by selling
or buying items listed on LoopCity.com, are responsible for ensuring
that the importation of that type of product complies with
applicable U.S. laws. These laws
often are complex, and issues will vary depending upon exactly what
item is involved and the countries in which the buyer and seller
reside.
International
Trading - Buyers
·
LoopCity.com insists that listings and transactions
comply with the laws of the countries where both the seller and the
high bidder reside. Members are responsible for ensuring that their
transactions are lawful in both countries. LoopCity.com strongly
suggests that members educate themselves about the laws of their own
country and the countries where they plan to do business.
International
Trading - Sellers
·
LoopCity.com insists that listings and transactions
comply with the laws of the countries where both the seller and the
high bidder reside. Members are responsible for ensuring that their
transactions are lawful in both countries. LoopCity.com strongly
suggests that members educate themselves about the laws of their own
country and the countries where they plan to do business.

Listings not offering an item or service for sale are
not permitted on LoopCity.com. These types of listings include but
are not limited to:

Devices
·
LoopCity.com does not permit the listing of any
lockpicking or locksmithing device.
Lottery
Tickets
·
LoopCity.com does not allow the sale of lottery
tickets
Mailing
Lists and Personal Information
·
LoopCity.com does not permit the sale of bulk email,
Internet Protocol (IP), Instant Messenger (IM), or mailing lists
that contain names, addresses, phone numbers, or other personal
identifying information. Any tools or software designed
predominantly to send unsolicited commercial messages (UCE or
"spam") will not be permitted.
Manufacturers'
Coupons LoopCity.com permits the listing of valid coupons on its
site, with some limitations. Please see ’Additional Information’ to
learn more about what limits are placed on the sale of coupons.
LoopCity.com is committed to working with the coupon industry to
help ensure that LoopCity.com is not a venue for fraudulent
coupon-related transactions and to providing its users with a safe
place to trade.
Mature
Audiences
Materials adult
in nature or otherwise not appropriate for minors (individuals under
18 years of age) Adult materials may not be listed on the
loopcity.com
Medical
Devices
·
For the health and safety of LoopCity.com users and to
encourage compliance with applicable laws, LoopCity.com has
instituted several rules relating to sales of medical devices on our
site. LoopCity.com allows the sale of professional medical devices
to authorized purchasers and sellers of medical devices must
strictly follow certain rules set out below when listing such items
on LoopCity.com.
Misleading
Titles
·
Sellers
are not permitted to create titles for their listings that do not
accurately describe the item for sale.
Mod Chips,
Game Enhancers, and Boot Discs
·
Mod chips, game enhancers and boot discs are devices
that enable domestic video game consoles to play backup or import
versions of video games. These devices are not permitted on
LoopCity.com.
Movie
Prints
·
35mm (millimeter) or 70mm movie prints are the reels
of film used by movie theatres to show movies. Only the copyright
owners of 35 mm and 70 mm movie prints or these owners’ authorized
licensees may list 35 mm or 70 mm movie prints on LoopCity.com.
These sellers must state their ownership or right to sell these
prints in their listings and be able to prove it to LoopCity.com.
This policy extends to 35mm and 70mm picture shorts, such as
cartoons.
Multi-level
Marketing, Pyramid and Matrix Programs

The listing and advertising of multi-level marketing
programs (including online payment randomizers), matrix, pyramid,
Ponzi schemes, and all similar programs are not permitted on
LoopCity.com. Such programs are often regulated or illegal.
OEM
Software
·
Original Equipment Manufacturer (OEM), or bundled
software, is software that is obtained as part of the purchase of a
new computer. Sellers may not list "OEM" or "bundled" copies of
software on LoopCity.com unless they are selling it with computer
hardware. OEM software licenses usually prohibit the purchaser from
reselling the software without the accompanying computer or without
any computer hardware.
Offensive
Material
·
Sellers may not list items that promote or glorify
hatred, violence, racial or religious intolerance, or items
that promote organizations with such views.
Pesticides
·
Sellers may not list Pesticides and any materials
regarding Pesticide.
Plants
and Seeds
·
Some federal, state, and local laws prohibit the sale
of certain types of plants or seeds that are considered "exotic" or
"noxious" weeds. The United States Department of Agriculture
prohibits the importation and interstate movement of federally
defined noxious weeds. USDA also prohibits or restricts
importation of other seeds for various reasons. These restrictions
often depend on the country of origin. Treatments or permits may be
required
·
Besides reviewing the list of prohibited noxious weeds
and seeds, buyers and sellers of plants or seeds should also review
the state-by-state list regulated noxious weeds, and
consult with state and local authorities to determine whether the
items they are considering buying or selling are legal in their
state.
·
Many state laws limit the time period after packaging
or germination testing within which agricultural or vegetable seeds
may be sold. If listed on the packaging of the seeds, sellers should
include in their item description the dates of packaging and
germination testing. Buyers and sellers of packaged seeds should
consult with state and local authorities to determine whether the
items they are considering buying or selling are lawful for
distribution in their states.
Police-Related
Items
·
LoopCity.com does not permit the listing of law
enforcement badges or official law enforcement equipment from any
public entity, including badges issued by the government of any
country. This prohibition extends to police badges and official
equipment from federal, state or local law enforcement agencies of
the United
States .
Political
Memorabilia
·
Sellers listing items in the political categories must
protect potential buyers by abiding by the Hobby Protection
Act. Sellers must also be aware of this law to protect
themselves from any violations of Federal law which could impose
fines, penalties, or both.
·
Political Memorabilia reproductions and fantasy items
must be clearly marked as such. Sellers must also state this in the
item description.
·
The font size of this reference text must be identical
to that of the rest of the listing.
·
These items must be listed in the Repros, Fantasy
Items category, which resides under the Political Memorabilia >
U.S.
category
·
This policy applies to all political memorabilia,
including buttons, posters, literature, stickers, or other forms of
political advertisements and candidate promotions.
Postage
Meters
·
Postage meters are not permitted on LoopCity.com,
because the sale by unauthorized dealers violates United States
Postal Service Regulations.
Pre-Sale
Listings
·
Pre-sale listings are those that describe items for
sale that are not in the control or possession of the seller at the
time of the listing. These listings generally consist of items that
are sold in advance of a delivery date to the public. LoopCity.com
does not permits Pre-sale listings.
Prescription
Drugs
·
Controlled drugs that require a prescription from a
licensed practitioner (such as a doctor, dentist, ophthalmologist or
optometrist) are not permitted on LoopCity.com; this includes drugs
prescribed by veterinarians for animals.
·
Sellers may not list medications that contain
pseudoephedrine or ephedrine on LoopCity.com. These medications now
require a prescription from a doctor in at least one state, and the
sale of these products is closely regulated by federal and state
law.
Prohibited
Services
·
Sellers are not permitted to offer or solicit services
on the LoopCity.com site that are illegal, sexual in nature or that
violate LoopCity.com’s User
Agreement.
Promotional
Items
·
Some companies distribute "promotional copies" of
movies, albums, or events to publicize the works before they are
released to the public. Promotional items are permitted on
LoopCity.com. However, many rights owners believe that listing these
items infringes on their copyrights. Listing such items could
therefore result in the ending of a listing if a member of
LoopCity.com’s Verified Rights Owner (VeRO) Program reports the
items as infringing their rights. When a rights owner reports a
listing to LoopCity.com as one that infringes their rights,
LoopCity.com is required by law to remove the listing.
Real
Estate
·
Selling an undivided interest in a land real estate
property is not permitted. An undivided interest is defined as a
partial interest by two or more people in the same property. This
prohibition shall not apply to mineral rights.
·
Auction-Style Format Items
·
Due to the wide variety of laws governing the sale of
real estate, LoopCity.com Real Estate auction-style advertisements
of real property do not involve legally binding offers to buy and
sell. Instead, LoopCity.com Real Estate's auctions are simply a way
for sellers to advertise their real estate and meet potential
buyers. LoopCity.com is commonly referred to as an online auction
web site, however LoopCity.com Real Estate is not a traditional
"auctioneer". LoopCity.com Real Estate is not involved in the actual
transaction between buyers and sellers and, as a result, has no
control over the quality, safety or legality of the properties
advertised, the truth or accuracy of the postings, the ability of
sellers to sell items or the ability of buyers to buy items.
LoopCity.com cannot ensure that a buyer or seller will actually
complete a transaction.

Auction-style format advertisements for the sale of
real estate are designed to assist the parties in identifying the
most interested potential buyer(s). The listings do not result in
binding agreements to buy and sell real estate; however, they do
allow sellers and buyers to use LoopCity.com Real Estate as a venue
to determine who may be most interested in the property. In this
format, potential buyers are asked not to bid unless they intend to
complete the purchase of the advertised property, subject to
customary diligence and contingencies. Following the close of the
auction-style bidding, the sellers and buyers are expected to
contact each other to prepare and deliver the appropriate paperwork
to buy and sell the property, and to take such other actions as may
be required by local laws. As noted below, LoopCity.com Real Estate
cannot give legal advice to buyers or sellers, and users should seek
professional advice when selling or buying real estate. Depending on
the property, sellers may be required to deliver to buyers a
disclosure statement prior to a sale, and in all cases buyers should
conduct their own due diligence related to property inspection,
title review, building code compliance, termite inspection, flood
plain, hazardous materials and other local issues transparent only
to an expert. While LoopCity.com Real Estate cannot guarantee
consummation of the sale to either seller or potential buyers, our
rules require sellers and top-bidding potential buyers to follow
through in good faith. If the parties do follow through in good
faith, but the transaction does not close, the parties should still
leave positive feedback for each other.

Ad Format Items
·
LoopCity.com Real Estate also offers sellers the
option of advertising their property in an "Ad" format rather than
an auction format .The Real Estate Advertisement format has the
following features:
You can list your asking price. No bidding takes
place.
·
Interested buyers fill out a contact form and their
information is sent to you.
·
You can advertise your property for 30 days or 90
days.
·
You may revise your item at any time in
the advertisement duration.
·
Real Estate Advertisement format listings do not
result in feedback, because the format aims to generate multiple
leads rather than a single high bidder. When this contact
information is forwarded to sellers via email, sellers are obliged
to treat the potential buyers’ contact information in full
compliance with LoopCity.com's Privacy Policy. This policy prohibits
use of the potential buyers’ information for any purpose other than
communicating with the potential buyers about the information and
services referenced in the item description, unless expressly
permitted to do so. Failure to comply with this policy can result in
seller expulsion from the LoopCity.com community. Once buyers and
sellers make contact through these listings, they can, as noted
above, then proceed to discuss off the website purchase terms,
including price, inspections, and the like, as is customary in an
offline real estate transaction.

Private Mortgage Notes
·
Within LoopCity.com's "Other Real Estate" pages,
LoopCity.com sellers are permitted to advertise for sale certain
purchase money notes and mortgages (referred to in these rules as
"mortgage notes"). These mortgage notes are created when, in a real
estate transaction preceding the offer of the mortgage note on the
LoopCity.com site, a purchaser of certain real estate obtains
financing for all or a portion of a property from the seller, and
executes a note in favor of the seller secured by a mortgage on the
real property being purchased. A mortgage note created in this
manner may be advertised for sale on LoopCity.com (in either the
auction format or ad format) if the following requirements are
satisfied:

the mortgage note must have arisen in connection with
a bona fide real estate transaction;
·
the interest offered constitutes the entire
indebtedness under the note;
·
the purchaser will receive the mortgage note by
unconditional endorsement, without recourse, together with a full
assignment of the mortgage securing the note, both of which the
purchaser will hold until satisfaction of the note;
·
the mortgage note is offered without any interposed
services or other enhancements to be provided by the seller;
and,
·
the sale of the mortgage note complies with all
applicable law.
·
All mortgage notes are required to be offered only in
the "Other Real Estate" category
Recalled
Items
·
LoopCity.com strongly supports the efforts of the U.S.
Consumer Products Safety Commission (CPSC) to protect consumers
against potentially hazardous goods. LoopCity.com does not permit
the listing of items that have been identified by the CPSC as
hazardous to consumers and therefore subject to a recall.
Recordable
Media
·
Only copyright owners, or the copyright owners’
licensees, are permitted to list their products copied onto
recordable media (such as VHS tapes, Audio tapes, CD-Rs and DVD-Rs)
on LoopCity.com. Sellers listing any type of recordable media must
state their copyright ownership or license to resell these items in
their listings and be able to prove it to LoopCity.com.
Replica
and Counterfeit Items
·
Counterfeits, unauthorized replicas, unauthorized
items (such as counterfeit watches, handbags, or other accessories)
or unauthorized copies (such as copies of software programs, video
games, music albums, movies, television programs, or photographs)
are not permitted on LoopCity.com. Unauthorized copies include (but
are not limited to) copies that are pirated, duplicated, backed-up
or bootlegged. It is illegal to sell unauthorized copies of
media.

Guideline: If the product
you are selling bears the name or logo of a company, but it wasn't
made or endorsed by that company, don't list it on LoopCity.com.
Satellite
and Cable TV Descrambers
·
Certain
electronics equipment, including equipment deemed unlawful by the
Federal Communications Commission (FCC), is not permitted on
LoopCity.com.
Slot
Machines
·
LoopCity.com will not generally permit the listing of
coin-operated slot machines on its website. The sale or even
ownership of coin-operated slot machines is regulated or forbidden
in a number of states, even for personal in-home use. The laws are
often complex and may subject violators to criminal penalties. To
see any exceptions to this policy, please expand the Examples
section below.
Stocks and
Other Securities
·
The sale of stock or other securities is not permitted
on LoopCity.com.
Stolen
Property and Property with Removed Serial Numbers
·
LoopCity.com strictly forbids the sale of stolen
property, which violates state, federal and international law.
LoopCity.com strongly supports law enforcement efforts to recover
stolen property that is listed on its Web site, and urges the
prosecution of those responsible for knowingly attempting to sell
such items on LoopCity.com.
·
LoopCity.com forbids its members from listing goods
that have altered or removed serial numbers, as the possession and
sale of such items is prohibited in a majority of states in the
U.S
Surveillance
Equipment
·
LoopCity.com does not permit the sale of products that
are designed primarily to record the private oral, wire or
electronic conversations of others without their knowledge or
permission. These small, easily hidden transmitting devices are
illegal to possess or sell under Title 18, United States Code
Section 2512, and their use also violates the law in many states and
countries.
Teacher's
Edition Textbooks Teacher’s editions of textbooks and solutions
manuals that are intended solely for use by teachers are not
permitted by LoopCity.com.
Test
Listings LoopCity.com permits the use of ‘test’ listings by its
members only in the Everything Else; Test Auctions category. See
“Additional Information” for guidelines for test listings.
Tobacco
·
Cigarettes, cigars, smokeless tobacco or coupons for
such items are not permitted on LoopCity.com.com. LoopCity.com will,
however, continue to be a forum for the sale of tobacco-related
collectibles, (including tobacco related memorabilia and packaging)
provided sellers comply with the above policy. These items are not
subject to the same legal constraints. Prior to listing any
tobacco-related items on LoopCity.com, sellers should read the
‘Additional Information’ sections to learn more about what
tobacco-related items are not permitted.
Transit
and Shipping Related Items
·
In order
to help support government, transit and shipping industry efforts to
ensure passenger and package safety, LoopCity.com does not permit
certain transit- and shipping-related items. Sellers wishing to list
these types of items on LoopCity.com must review the ‘Additional
Information’ section below and adhere to the rules outlined.
Travel
·
Sellers who want to list travel-related items must
adhere to all rules outlined in the Examples section below.
·
Providers of Travel: Businesses that
actually provide travel services, such as airlines, trains, hotels,
resorts, and cruise ships, may list items such as their own gift
certificates, airline tickets, lodging, cruises, or vacation
packages. As providers of the actual travel service, they are often
exempted from seller-of-travel laws and need not provide travel
licensure information. However, they should clearly identify
themselves in the listing as the actual provider of the travel
services offered.
·
Travel agents, and other businesses selling travel
services: Businesses and individuals who sell and/or
arrange air or sea travel or accommodations (but do not directly
provide the travel service themselves) may list air and ship related
travel items (i.e. airplane tickets and cruise trips), along with
accommodations, on LoopCity.com only if they are licensed as sellers
of travel lawfully able to do business in all 50 states and they
themselves will be booking the travel for the winning bidder. Their
listings should clearly set out their California
seller of travel license number as well as any other
license information required in other states. It is against
LoopCity.com policy for travel clearinghouse affiliates, that are
not actual agents booking the travel themselves, to list travel
auctions on the site. Sellers are required to include the following
disclaimer in all listings for travel exactly as it appears below
and in a text size and color that can easily be seen and read by all
bidders:

"By listing this auction I verify that I am the actual
travel agent or travel provider and not a third party affiliate. The
travel/accommodations in this auction will be booked directly
through me and not an outside agency. I also verify that, other than
the government taxes and related government fees stated within the
listing description itself, there will be absolutely no additional
fees, charges or after auction purchases associated with booking the
travel within this listing."
·
For travel services other than air or sea travel,
businesses and individuals may offer gift certificates or coupons
that are issued by a specific provider of travel, such as a gift
certificate to a particular hotel. They may not, however, offer
travel club memberships or "choice travel" certificates (see
below).
·
Individuals: Individual travelers who are not
in the business of selling travel services, but simply wish to sell
an unused air or sea related travel voucher or gift certificate, may
do so no more than one trip per month provided that the item is not
a travel club membership or "choice travel certificate," (see below)
or related item. In such instances, the seller may play no role in
arranging any travel other than delivering the item. Please note
that many airline tickets, vouchers, and frequent flier miles are
not transferable, and sellers should review any travel related item
before listing to make sure that it can be transferred legally to
another party and will be accepted by the issuing provider of travel
services.
·
Travel club memberships and "choice travel"
certificates: LoopCity.com will not permit listings of travel
club memberships or "choice travel certificates" or similar items by
any user. Travel club memberships include any service, cards, or
identification number that purports to give the holder the right to
free or discounted travel, that is, certificates that entitle the
holder to some travel related benefit (such as free or low cost
hotel stays) with a variety of travel providers.
·
LoopCity.com does not permit listings of "choice"
travel certificates by any user. Choice travel certificates are
documents that are not issued directly by a single provider of
travel, but by travel wholesalers, consolidators, or other middleman
travel sellers. These certificates generally offer the holder free
or low-cost travel services with a choice of multiple hotel chains,
resorts or airlines, the exact location often being at the choice of
the buyer or seller. Such certificates are highly regulated in many
US states and in many
cases require additional purchases that violate LoopCity.com's fee
circumvention policies. They may not be listed on LoopCity.com by
any user.
Unauthorized
Copies
·
Counterfeits, unauthorized
replicas, unauthorized items (such as counterfeit watches, handbags,
or other accessories) or unauthorized copies (such as copies of
software programs, video games, music albums, movies, television
programs, or photographs) are not permitted on LoopCity.com.
Unauthorized copies include (but are not limited to) copies that are
pirated, duplicated, backed-up or bootlegged. It is illegal to sell
unauthorized copies of media.
Used
Clothing
·
Used clothing (except underwear) may be listed on
LoopCity.com as long as the clothing has been thoroughly cleaned
according to the manufacturer's instructions. Listings that contain
inappropriate descriptions will be ended.
Used
Cosmetics
·
Used cosmetics are not permitted for sale on
LoopCity.com.
Warranties
LoopCity.com members who
offer items on LoopCity.com valued at more than $15 and who offer
either a written warranty or service contract with the items must in
their item descriptions provide one of the following:

The full text of the written warranty
·
A statement explaining how a free copy of the written
warranty can be obtained upon written request.
·
A link
within the listing that takes members to the warranty details
Wine (also
see Alcohol)
·
LoopCity.com does not permit
the sale of alcoholic beverages on its U. S.
website, except for certain pre-approved sales of wine
(see Additional Information) and certain sales of collectible
containers. Further, non-U.S. members may not conduct alcohol sales
with any LoopCity.com member residing in the United
States .
